While crossing the street in Brooklyn, New York, our 55-year-old client was struck by a car that failed to yield the right of way to her as she was in the crosswalk. The defense tried to argue the driver had the green light, which witnesses confirmed he did. However, the same witnesses testified there was plenty of time for the driver to have slowed and yielded to the pedestrian. Our client suffered multiple injuries, including three broken bones to her leg, two fractured ribs and a traumatic brain injury. The car was insured with two $1,000,000 policies from two different insurance companies. Ultimately, rather than face a trial, the insurance companies agreed to pay the full extent of all available insurance.
