After firing one of their drivers two times for speeding, a trucking company re-hired the same driver because the trucking company only makes money when their trucks are on the road. While driving on a NY highway in Chautauqua County, the same driver of the trucking company was traveling at speed of 65 MPH. The driver never slowed down for the disabled car located in his lane of travel. Without taking any evasive action to move into the open passing lane, the truck crashed into the rear of the disabled car killing our client, a 20-year-old single mother of a 16-month-old baby boy. The child is now being raised by his grandmother. The case settled for all available insurance coverage, which totaled $5,315,000.
The case was handled by Managing Partner Andrew Finkelstein, Trial Partner Victoria Lightcap and Partner Elizabeth Wolf.
