When a commercial van driver failed to yield the right of way to our client, catastrophic consequences were caused. Our 18-year-old client was driving in Palmer, Massachusetts on his motorcycle when, without warning, another driver chose to cut across our clients lane of travel. Rather than crash head on into the van, our client tried to put down his bike, but he still struck the van. The impact broke the vertebrae in his low back and severed his spine, leaving him paralyzed from the waist down. Our investigation showed the commercial van driver routinely cut the corner when crossing the street to go from one warehouse to another. After re-creating the event with a powerful forensic animation, the insurance companies realized rather than try to defend the case, they needed to make substantial offers. Ultimately, the case was settled two years before trial.
The case was handled by Trial Partners Marc Diller and Andrew Finkelstein.
