$8,500,000 Settlement: Pedestrian Killed By Confused Driver

A television news van was en route to Montefiore Nyack Hospital in Rockland County at 6 AM, to cover a breaking news story. After missing the main entrance to the hospital, the van’s driver attempted a U-turn just past the employee entrance. As the driver was turning, he struck our client as he was crossing the street to go to work at the hospital. Our forty-three-year-old client was a married father of three. The television company attempted to argue that our client was not a US citizen, so the damages should be lower. However, Finkelstein & Partners argued that the law of damages does not discriminate based on citizenship. Prior to trial we were able to settle the case for $8,500,000, which is a record settlement for a wrongful death case in Rockland County.

The case was handled by Managing Partner Andrew Finkelstein, Trial Partner Brian Acard and Partner Ed Steves.
